1. About Secure Express

Secure Express (SE) is a South African-based secure on-demand e-hailing platform designed to offer safe, reliable, and accountable transport solutions.
We operate our own 100% owned vehicle fleet, managed and monitored by our Johannesburg-based operations team to ensure safety, reliability, and customer satisfaction.

2. Acceptance of Terms

By using the Services, downloading the Secure Express app, or creating an account, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Cookie Policy.
If you are using the Services on behalf of another person or entity, you represent that you have the authority to accept these Terms on their behalf.

3. Eligibility

To use our Services, you must:

Be at least 18 years old (or the legal age of majority in your jurisdiction);

When you book a ride through the Secure Express app or website, you agree to the displayed fare and applicable terms before confirming.
All fares, fees, and charges are subject to change and will be clearly displayed before you complete a booking.
Cancellation policies and fees may apply depending on the timing of your cancellation.

Secure Express reserves the right to cancel bookings for operational, safety, or technical reasons. In such cases, reasonable effort will be made to notify you promptly.

7. Intellectual Property

All content, branding, logos, software, and materials available through the Services are the intellectual property of Secure Express or its licensors.
You may not copy, reproduce, distribute, or modify any part of the Services without prior written consent.

8. Privacy and Cookies

You agree to comply with the applicable Google Play Store or Apple App Store terms of service;
The app may request access to certain device features (such as location services) to enable key functionalities like ride tracking, navigation, and safety monitoring;
Updates may be automatically downloaded and installed to maintain app performance and security;
You are responsible for maintaining compatible hardware and software to access the app properly;
Secure Express is not responsible for any issues arising from third-party app store operations or disruptions.

Both Google and Apple are not responsible for providing support or warranty for the Secure Express app.
All app support, bug fixes, and user assistance are handled directly by Secure Express.

10. Third-Party Services and Links

Our Services may include links to external websites or integrations with third-party platforms (such as social media or payment providers).
We do not control, endorse, or assume responsibility for third-party content, policies, or practices. Accessing third-party services is at your own risk.

11. Disclaimer and Limitation of Liability

Secure Express provides the Services “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, Secure Express and its affiliates are not liable for:

Indirect, incidental, or consequential damages;
Data loss, unauthorized access, or system interruptions;
Any losses resulting from misuse, third-party service interruptions, or failure to comply with these Terms.

Our total liability in connection with these Terms shall not exceed the total amount paid by you (if any) in the preceding six months.

You agree to indemnify and hold harmless Secure Express, its affiliates, employees, and contractors from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

Upon termination, your right to use the Services will cease immediately.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
Any disputes arising from these Terms shall be resolved in the competent courts of Johannesburg, Gauteng.
